Terms and Conditions

kleiner KNIFF with supplementary terms for shanQ · Updated: 8 September 2026 · Version 1.1

General Terms and Conditions of kleiner KNIFF

1 Provider and scope

These General Terms and Conditions govern the contractual relationship between kleiner KNIFF, sole proprietorship, Bergackerstrasse 56, 8406 Winterthur, Switzerland, info@kleinerkniff.ch, and persons subscribing to a paid digital offering from kleiner KNIFF. They apply together with the supplementary terms of the selected product. In the event of a conflict, the product-specific provisions take precedence for the matter concerned.

2 Offering and conclusion of the contract

The presentation of a product is an invitation to place an order. Before a paid subscription is concluded, the product, scope of services, price, billing period, any trial period and renewal terms are displayed. The contract is concluded when the person placing the order confirms the clearly identified paid subscription and kleiner KNIFF confirms the order electronically.

Input errors can be corrected before the contract is concluded. The applicable legal documents can be opened and saved beforehand. kleiner KNIFF records the accepted document versions and the time the contract was concluded.

3 Account and access

A personal account is required for personalised offerings. Information must be accurate and up to date. Access credentials must be kept confidential and must not be shared without authorisation. Suspected misuse of an account must be reported to kleiner KNIFF immediately.

An account, a payment, being the contracting party and a role within a product confer different permissions. Payment does not automatically grant access to another person's personal content.

4 Minors

The offerings may in principle also be available to minors where the product-specific terms permit this. Minors may only enter into a paid contract if they are legally entitled to do so or have the required consent of their legal representative. kleiner KNIFF does not verify age or legal representation for every purchase, but may request appropriate evidence where there are reasonable doubts.

5 Prices and payment

The price displayed at checkout in Swiss francs applies. Prices include any VAT legally due. Recurring fees are charged at the start of each billing period.

Payments are processed through Stripe. In particular, names, email addresses, billing details, payment methods, amounts, currencies, transaction statuses and technical security and fraud-prevention data may be transmitted to Stripe. Card details and comparable payment data are processed directly by Stripe. Stripe's terms and privacy notices additionally apply to the payment interface. kleiner KNIFF remains responsible for its own contract, support and handling of justified refund requests, except where mandatory rules of an app store or payment provider take precedence.

6 Trial period and renewal

If a free trial period is offered, its duration and the date of the first charge are displayed before the contract is concluded. Unless cancelled in time, the trial period converts into the selected paid membership. The membership subsequently renews for the selected billing period each time.

7 Cancellation and refunds

A membership may be cancelled at any time with effect from the end of the current billing period. Access remains available until that date. Fees already paid are not refunded on a pro-rata basis upon ordinary cancellation.

Mandatory statutory rights remain unaffected. This applies in particular to incorrect charges or substantial failure to provide the service for which kleiner KNIFF is responsible and which has not been remedied. Purchases made through an app store are additionally subject to its mandatory processing and refund procedures.

8 User obligations

The offerings may only be used lawfully and for their intended purpose. In particular, circumventing access restrictions, attacks on systems, automated overloading, unauthorised copying or distribution of protected content, and entering unlawful content or content that infringes third-party rights are prohibited.

9 Availability and changes

kleiner KNIFF endeavours to operate reliably but does not guarantee uninterrupted availability. Maintenance, security measures, disruptions at third-party providers or events beyond its reasonable control may temporarily affect access.

Features may be developed further provided that the essential contractual benefit is maintained. Significant adverse changes will be communicated in good time. If such a change cannot reasonably be accepted by the affected person, they may cancel with effect from the date of the change.

10 Intellectual property rights and user content

Software, design, texts, audio, trademarks and other content provided are legally protected. Membership grants a personal, non-transferable right of use for the duration of the contract.

Users retain their rights to their own inputs. They grant kleiner KNIFF the authority to process them as necessary to provide the selected functions, limited to that purpose.

11 Liability

kleiner KNIFF is liable in accordance with mandatory statutory provisions. To the extent permitted by law, liability for slight negligence, indirect damage and loss of profit is excluded. No limitation of liability applies in cases of unlawful intent or gross negligence, or where mandatory law precludes it.

Supplementary terms for shanQ

1 Scope and services

These supplementary terms apply to the use of shanQ. shanQ provides digital content, programmes, dialogues, audio routines, personal notes and golf-related planning and reflection functions. The specific scope of services depends on the selected membership and the product version available at the time.

2 Personal responsibility in sport and everyday life

shanQ supports reflection, training and preparation for sport. Content and AI outputs do not replace medical, psychological, legal or other professional advice. Users assess recommendations and decisions independently and take their personal circumstances into account.

3 Personal notes and AI support

Personal notes are user content linked to their account. Accompanying persons, group members, paying persons and other users do not gain access solely by virtue of their role.

When the function “Talk to shanQ about your notes” is used, shanQ incorporates all personal notes stored in the account at that time, the current question and the conversation history about the notes necessary to answer it. This content is processed by the AI service named in the Privacy Policy to generate the requested answer. Additional confirmation for each individual question is not required.

AI outputs may be incomplete, misleading or factually incorrect. shanQ must not present facts not contained in the notes as established. Users should verify important statements themselves and should not enter content that is unnecessary for the intended purpose.

4 Editing and deleting personal content

Users may edit or delete personal notes using the account functions provided. Deleted notes are no longer included in future conversations about notes. The Privacy Policy governs details of processing, service providers used, retention and the rights of data subjects.

5 Changes and final provisions

The General Terms and Conditions of kleiner KNIFF apply to changes in the scope of services, availability, liability, cancellation and other contractual matters. Mandatory statutory rights remain unaffected.
